Beacon Foundation (ABN 42 129 090 464) (we, us, our) is committed to protecting your privacy.

This Privacy Statement explains our policies and practices in relation to the handling of personal information that may be collected through eBeacon. This Privacy Statement does not apply to personal information collected by us elsewhere. For information about how we manage personal information generally, see the Beacon Foundation Privacy Policy.

1.  What personal information do we collect?

Personal information is information or an opinion, in any form and whether true or not, about an identified individual or an individual who is reasonably identifiable. Examples include an individual’s name, address, contact number, date of birth and email address.

The type of personal information we collect about you will depend on how you use eBeacon. For example, personal information is collected when you:

  • register to become a user of eBeacon (User);
  • send a message to another User using the direct messaging function;
  • book in for or participate in chats with another User using a live text chatting function on eBeacon; or
  • book in for or participate in a live video streaming session on eBeacon.

We may also keep records of any other interactions you have with us (for example, emails or other correspondence you send via eBeacon), together with any other information that you choose to provide to us.

In some circumstances, we may collect sensitive information about you (for example, if you post a comment on eBeacon about your health or professional memberships). We will not do this unless you have consented to the collection (including by posting the relevant information), or if we are otherwise required or authorised to do so by or under law. Sensitive information includes (for example) health information and information about a person’s racial or ethnic origin, political opinions, religious beliefs, professional or trade association membership, sexual preferences and criminal record.

If you do not provide us with the personal information that we request, you may not be able to use eBeacon or the services available on eBeacon.

2.  Providing us with personal information about others

If, at any time, you provide personal information about another person, you warrant that you have made that person aware of this Privacy Statement and the Terms of Use and that you have obtained that person’s consent to provide their personal information to us.

3.  How do we collect personal information?

We will generally collect personal information directly from you, when you post or submit information on eBeacon.

We may also collect personal information if you interact with eBeacon in other ways. For example, we may capture a recording of you if you participate in a live video streaming session on eBeacon.

Collection of information other than personal information

Some of the information that is collected about your visit to eBeacon is not personal information, because it does not reveal your identity. For example, we may record your server address, the date and time of your visit, the pages you viewed, any documents you downloaded and the type of browser and operating system you used.

If collected, this information may be used and disclosed by us in anonymous, aggregated form only, for purposes including statistical analysis and web site development. You are not individually identified, however we reserve the right to use or disclose this information to try to locate an individual where we reasonably believe that the individual may have engaged in any unlawful or inappropriate activity in connection with eBeacon, or where we are otherwise required or authorised by law to do so.

Cookies

A cookie is a small string of information that a website transfers to your browser for identification purposes. We may use cookies to gather information about your visits to eBeacon and enhance your experience. The cookies we use do not identify individual users, although they do identify the user’s internet browser. We may use cookies to maintain session information about you when you log into eBeacon and that information helps us to understand your preferences and improve your eBeacon experience.

We use only non-persistent cookies, that is, they are held on your browser’s memory only for the duration of your session.

Most internet browsers are set to accept cookies. If you prefer not to receive them, you can adjust your internet browser to reject cookies, or to notify you when they are being used. There are also software products available that can manage cookies for you. If you disable cookies, we may be not be able to optimise your visit to eBeacon and certain features may not be available.

4.  Why do we collect personal information?

We use the personal information we collect through eBeacon for the purposes for which it was provided and for any other purposes explained at the time of collection or in any additional terms and conditions applicable to the particular feature of eBeacon, including:

  • to operate eBeacon and the services available on eBeacon;
  • to provide support for users of eBeacon;
  • to respond to questions and requests;
  • to conduct research and development;
  • to investigate any complaints made by or about you, or if we have reason to suspect that you are in breach of our Terms of Use or have been engaged in any unlawful activity; and
  • for other purposes required or authorised by or under law, including purposes for which you have provided your express or implied consent.

Material posted by users

Some of the services offered through eBeacon may allow Users to submit, upload, post or transmit content or material such as text, photos, images, audio and video (including links to content or material) that may be accessed and viewed by other Users (Material). You acknowledge that we cannot guarantee that Material will not be copied, downloaded or used otherwise. If you have concerns about your personal information being published in this way, you are advised to remove any personal information from the Material you post.

As indicated in the Terms of Use, we may use Material for our promotional purposes. This may include using Material which may include personal information (for example, your photo).

5.  When do we disclose personal information to third parties?

We may disclose your personal information:

  • for the purpose for which that personal information was collected; and
  • for the purposes set out under heading 4 above.

Personal information may be disclosed for these purposes to:

  • other Users;
  • our stakeholders;
  • our contracted service providers, which may include:

o      website development, information technology and security providers;

o      database management and data processing analysts; and

o      external business advisors (such as accountants, auditors, recruiters and lawyers).

The third parties identified above may provide us with personal information they have collected from you, for the purposes set out in this Privacy Statement. Any personal information collected from third parties will be used and disclosed in accordance with this Privacy Statement.

6.  Links to third party websites

Any links to other websites are provided for your convenience. We are not responsible for the privacy practices of those sites, and you should review their privacy policies before supplying any personal information to them.

7.  Quality and security of personal information

We take steps to ensure that the personal information we collect, use and disclose is accurate, complete, up to date and relevant. You can help us, by letting us know about any changes to your personal information, such as email address or phone number.

Security

With the exception of personal information contained in Material, we strive to protect the personal information and privacy of users of eBeacon. However, no data transmission over the Internet can be guaranteed as totally secure. Accordingly, we cannot ensure the security of any information you transmit to, from or using eBeacon and you do so at your own risk.

You can help to protect the privacy of your personal information by keeping passwords secret and by ensuring that you log out of the site when you have finished using it. In addition, if you suspect any security breach, please let us know immediately.
